Castle Bound Travel Company – Terms & Conditions & Privacy Policy
Effective 2025
 
1. Use of CBTC Services, Access, and Booking Authorization
By booking travel services through Castle Bound Travel Company (“CBTC”) or any of its affiliated independent contractors, you represent and warrant that you are at least 18 years of age and have the legal authority to enter into this agreement, make travel bookings, and accept these Terms & Conditions on behalf of yourself and any individuals in your traveling party.


You agree to be financially responsible for all travel bookings made by you or on your behalf through CBTC. All information provided must be truthful, accurate, and complete.


Only legitimate, authorized travel reservations may be made through CBTC. Any speculative, fraudulent, or false bookings are prohibited and may be cancelled without notice and subject to legal action.
All travel bookings are accepted by CBTC as an advisor for the third-party travel suppliers listed in your itinerary. Each supplier has its own terms and conditions, which apply independently to your reservation. By confirming your booking, you agree to abide by all applicable supplier policies and hold CBTC harmless for any disputes or issues that may arise directly with those suppliers.
 
2. Travel Agency vs. Travel Advisor Understanding
CBTC is not the source or provider of the travel services purchased. CBTC serves solely as an intermediary and booking agency on behalf of its affiliated independent contractors (“ICs”). Your designated travel advisor operates as an independent contractor and is solely responsible for handling your travel arrangements in accordance with CBTC policies.
All travel advisors affiliated with CBTC are independent contractors and not employees, partners, joint venturers, or legal representatives of CBTC. CBTC does not control the day-to-day operations of independent contractors and is not liable for their personal actions, omissions, or representations outside of CBTC’s official booking systems.
 
3. Ownership of Bookings
All travel bookings facilitated through CBTC, whether by CBTC directly or by an affiliated independent contractor, are the property of CBTC. In the event an advisor’s affiliation with CBTC ends, the client’s booking remains with CBTC and will be reassigned to another CBTC advisor.
 
4. Travel Documentation Requirements
It is the sole responsibility of each traveler to research, confirm, obtain, and carry all required documentation necessary for travel to their specific destination. This includes, but is not limited to:

  • Passport validity (minimum six months beyond return date)
     

  • Visas and/or transit visas
     

  • Vaccination records and health forms
     

  • Any entry, exit, or transit requirements imposed by the country(ies) visited
     

CBTC does not confirm or verify entry requirements for any destination and is not liable for denied boarding, entry refusal, delays, or cancellations resulting from insufficient, expired, or improper documentation.


Travelers must confirm all requirements directly with official government sources, including the U.S. Department of State, the destination country’s embassy or consulate, and airline or cruise line travel notices, prior to departure. Any loss of funds or additional expenses due to failure to meet these requirements is solely the responsibility of the traveler.
 
5. Entry & Exit Requirements
Travelers with criminal records or other legal restrictions may be denied entry into certain countries. It is the traveler’s sole responsibility to confirm all entry and exit requirements before booking. CBTC does not inquire into or verify eligibility for entry and is not liable for denial of boarding or entry refusal.
 
6. Payments
Final payment is due in accordance with each supplier's terms. Failure to pay on time may result in cancellation and forfeiture of funds. Payments will be processed by your travel advisor on your behalf using CBTC’s authorized payment system. Direct payments to vendors may not be permitted. Clients must complete CBTC’s Credit Card Authorization form to approve any charges.
 
7. Third-Party Vendors
For bookings involving third-party vendors (e.g., excursions, transfers, babysitting services), CBTC and its affiliated agents assume no liability. All risks including injury, loss, missed transportation, illness, or dissatisfaction must be addressed directly with the third-party provider. You waive the right to hold CBTC liable for any claims arising from such services.
 
8. Travel Insurance
CBTC strongly encourages the purchase of travel insurance. If declined, you accept the risk of non-refundable expenses in the event of cancellation, delay, or emergency. All claims must be submitted directly to the insurance provider. CBTC is not responsible for interpreting coverage or assisting with claims.


9. Assumption of Travel Risk
Travel involves inherent risks, including illness, injury, natural disasters, acts of terrorism, or government policy changes. CBTC is not liable for any losses, injuries, or delays arising from these events. You acknowledge and accept all associated risks when booking travel services.


10. Force Majeure
CBTC is not responsible for disruptions caused by events beyond its control, including but not limited to acts of God, natural disasters, pandemics, political unrest, supplier bankruptcy, or labor strikes. Refunds or compensation are not guaranteed.


11. Supplier Failure or Insolvency
If a supplier fails to provide purchased services due to insolvency, bankruptcy, or cessation of operations, CBTC is not responsible for refunds. Recovery of funds must be sought directly through the supplier, credit card provider, or travel insurance.


12. Pricing, Currency & Foreign Transaction Fees
Prices are subject to change and are not guaranteed until full payment is made. Suppliers may charge in foreign currency, resulting in conversion fees or foreign transaction charges by your bank or credit card provider. CBTC is not responsible for these fees.


13. Unused Arrangements, Minimum Passenger Requirements, and Alterations to Bookings
Some bookings may be based on group or contract rates and may require a minimum number of participants. If minimum participation is not met, suppliers may impose surcharges, modify itineraries, or cancel the trip. CBTC is not liable for supplier changes or cancellations.
No refunds or compensation will be provided for unused travel components, including missed excursions, skipped meals, or early departures.


14. Right to Modify Terms & Conditions
CBTC reserves the right to update or modify these Terms & Conditions at any time. Continued use of our services constitutes acceptance of the updated terms. Independent contractors must sign updated agreements each December for the following year. Failure to sign may result in termination of affiliation.

 

15. Limitations of Responsibility & Legal Disclosure
CBTC acts solely as a booking agent for third-party travel suppliers. All services are provided by independent entities with their own policies. CBTC’s financial liability, if any, is limited to the amount of commission or fees actually received by CBTC for the affected booking.


16. No Reliance on Marketing Materials
Descriptions, photographs, and other marketing materials provided by suppliers are for general informational purposes and may not reflect current conditions. CBTC is not responsible for supplier-provided content.

17. Right to Correct Errors
CBTC reserves the right to correct pricing, availability, or booking errors at any time. Clients will be notified of any material changes and given the option to accept or cancel.

18. Limitations on Legal Claims and Chargebacks
Clients agree not to dispute charges or initiate chargebacks related to dissatisfaction with third-party suppliers. Concerns about service quality must be directed to the vendor.

19. Dispute Resolution & Governing Law
These Terms & Conditions are governed by the laws of the State of [Your State]. Any legal action must be filed exclusively in the state or federal courts located in [County, State], and both parties consent to such jurisdiction.

20. Marketing & Communications
By booking travel services with CBTC, you consent to receive promotional emails, newsletters, and marketing materials related to travel products, services, and special offers from CBTC and its affiliated independent contractors. You may opt out of marketing communications at any time by using the “unsubscribe” link provided in the emails or by contacting CBTC directly.

21. Access to Third-Party Travel Accounts & Loyalty Programs
If a client provides CBTC or their assigned travel advisor with login credentials, loyalty program numbers, or other account access information for third-party travel services (including but not limited to My Disney Experience, cruise line accounts, airline frequent flyer programs, and hotel loyalty accounts), the client grants CBTC and its travel advisors permission to use such access solely for the purpose of planning and managing the client’s travel reservations.

For example, in the case of My Disney Experience, the client’s consent includes but is not limited to linking tickets, making dining or event reservations, adding magical extras, and ensuring travel components are properly coordinated.

If a client chooses not to grant CBTC or its advisors access to these accounts, the client acknowledges that they are solely responsible for completing all associated tasks, including but not limited to linking reservations, managing tickets, making dining reservations, and adding any extras to their trip.
CBTC will not be responsible for delays, missed opportunities, or unavailable reservations resulting from the client’s decision to withhold account access.

 

22. Software Provider
We engage third-party service providers to support the delivery and functionality of our Platform, including specialized travel planning and itinerary management tools. This includes Travefy, a service provided by Travefy, Inc., which supplies itinerary creation, trip management, client communication, and organizational tools used by Castle Bound Travel Company.

In connection with its services, Travefy, Inc. may access, process, or store Personal Information solely for the purpose of operating, maintaining, and supporting our travel planning processes. Such processing is conducted in accordance with Travefy’s Privacy Policy, Security practices, and Data Processing terms, which outline its obligations regarding data protection, confidentiality, and regulatory compliance.

23. Privacy Policy

CBTC values your privacy. We do not sell or rent your personal information. Your data may be shared only with vendors, suppliers, or affiliates involved in your travel booking process.
